Release Roman Polanski for a 'More Elevated' Civilization
"Since
the Roman Empire, a majority of civilized nations have considered that the
passage of decades gradually eases the trouble provoked by the original act. … While
such forgetfulness seems unjust to the unforgiving; it is nevertheless a pillar
of penal wisdom."
Los Angeles District Attorney Steve Cooley says Polanski's arrest was simply a matter of concluding a legal proceeding that has been in limbo since the filmmaker fled the United States in 1978.
Who would still say that
Roman Polanski benefits from preferential treatment? To the contrary, the cold
mechanical judiciary advances inexorably, whatever his supporters or defenders may
say. In prison for weeks, the filmmaker has seen his applications for freedom refused
and the procedural gears of extradition rotate without a snag.
Is this just? For followers
of an inflexible justice, a justice that never gives up - yes. They are the
majority in the United States. For the others - no. There exists in effect only
one argument in favor of Polanski, but it's a decisive one - even if his
initial guilt is obvious: time. We hear well that the statute of limitations
cannot juridically apply in this case: in California it doesn’t apply for this
type of crime. In France, the sentence would have been interrupted by all kinds
of judicial action. But this is a case of principal and a frame of mind. Since the
Roman Empire, a majority of civilized nations have considered that the passage
of decades gradually eases the trouble provoked by the original act.

While such forgetfulness seems
unjust to the unforgiving; it is nevertheless a pillar of penal wisdom and the proper
adjuvant of the administration of justice. All the more so in this case, since
the victim, too, asks that we turn the page. No privilege therefore, for
Polanski, who suffers more from his celebrity in this case than he benefits
from it. We make only a logical and general plea, the same for all, in favor of
a principal that translates in every culture to a more elevated civilization.
